1. The User hereby consents, expresses and agrees that he/she/it has read and fully understands the Privacy Policy of the Company (as mentioned below) in respect of the Application and the terms and conditions thereof are acceptable. 1.1. The Company provides this Privacy Policy to help the User to make an informed decision about whether to use or continue using the Application. If the User does not agree to the practices of the Company, please do not use the Application. 1.2. This Privacy Policy is incorporated into and is subject to the Company�s terms of Service. 2. What Does This Privacy Policy Cover? 2.1. This Privacy Policy is part of the Application, terms of Service and covers the treatment of user information, including personally identifying information, obtained by the Company, including information obtained when the User accesses the Application, uses the Service or any other software provided by the Company. 2.2. This Privacy Policy does not apply to the practices of companies that the Company does not own or control, or to individuals whom the Company does not employ or manage, including any of the third parties to which the Company may disclose the User�s information as set forth in this Privacy Policy. |

3. The Information the Company Collects: The Company may obtain the following types of information from or concerning the User or the User�s mobile phone device, which may include information that can be used to identify the User as specified below; 3.1. Personally Identifying Information: 3.2. Cookies Information: When the User uses the Application, the Company may send one or more cookies a small text file containing a string of alphanumeric characters � to the User�s computer that uniquely identifies the User�s browser. The Company uses both session cookies and persistent cookies. A persistent cookie remains after User closes his/her browser. Persistent cookies may be used by the User�s browser on subsequent visits to the site. Persistent cookies can be removed by following the User�s web browser help file directions. A session cookie is temporary and disappears after User closes his/her browser. The User can reset his/her web browser to refuse all cookies or to indicate when a cookie is being sent. However, the Company�s Application may not function properly if the ability to accept cookies is disabled. 3.3. Log File Information: When the User uses the Company�s Application, servers of the Company automatically record certain information that the User�s web browser sends whenever he/she visits any website. These server logs may include information such as User�s web request, Internet Protocol, address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of User�s request, one or more cookies that may uniquely identify his/her browser, his/her phone number, phone number he/she is requesting the status of and various status information. When a User uses the Service, it�s servers log certain general information that its application sends whenever a message is sent or received, or if a User updates or requests any status information, including time and date stamps and the mobile phone numbers the messages were sent from and to. 3.4. The Information Company Does Not Collect: The Company does not collect names, emails, addresses or other contact information from its users; mobile address book or contact lists other than mobile phone numbers; the Application will associate whatever name the User has assigned to the mobile telephone number in his/her mobile address book or contact list; and this occurs dynamically on the mobile device itself and not on Company�s servers and is not transmitted to the Company. This means that if User has his/her friend�s mobile phone number associated with the name in User�s mobile address book, that the name that will appear for that mobile phone number in his/her contact list. The Company does not collect location data unless the User allows it to do so and the User may voluntarily share its location with other users via the Service. 3.5. The Way Company Uses Information 3.6. If the User submits Personally Identifiable Information to the Company through the Company�s Application, or Service, then the Company uses personal information of the User to operate, maintain, and provide to him/her the features and functionality of the Company�s Application and the Service. In particular, the User�s mobile phone number is essential to use of the Service by the User and will be retained. Any billing information that may be collected from the User will be deleted thirty (30) days after the termination of his/her account with the Company. 3.7. Any Personally Identifiable Information or status content that the User voluntarily discloses on the Service becomes publicly available and may be collected and used by other users of the Company�s Service (unless such user is blocked by the User). The User�s name (as it is saved in other users mobile phone address book or contact list) may be displayed to other users when he/she updates status messages through the Service and other users may contact the User through the Service. The Company does not use mobile phone numbers or other Personally Identifiable Information of the User to send commercial or marketing messages without his/her consent or except as part of a specific program or feature for which the User will have the ability to opt-in or opt-out. The Company may, however, use the mobile phone number of the User (or email address, if provided) without further consent for non-marketing or administrative purposes (such as notifying of major Company�s Application or Service changes or for customer service purposes). The Company may use both Personally Identifiable Information and certain non-personally-identifiable information of the User (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Company�s Application and Service and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends. The Company may use cookies and log file information to: (a) remember information so that User will not have to re-enter it during his/her visit or the next time the User uses the Service; (b) provide custom, personalized content and information; (c) monitor individual and aggregate metrics such as total number of visitors, pages viewed, etc.; and (d) track your entries, submissions, views and such other items. 3.7. When Company Discloses Information: The Company does not sell or share Personally Identifiable Information of the User (such as mobile phone number) with other third-party companies for their commercial or marketing use without his/her consent or except as part of a specific program or feature for which the User will have the ability to opt-in or opt-out. The Company may share Personally Identifiable Information of the User with third party service providers to the extent that it is reasonably necessary to perform, improve or maintain the Service. The Company may share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, asset views, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Company�s Application. The Company may collect and release Personally Identifiable Information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws, international law or respond to a court order or search warrant or equivalent, or where in the Company�s reasonable belief, an individual�s physical safety may be at risk or threatened. The Company also reserves the right to disclose Personally Identifiable Information and/or non-personally-identifiable information that the Company believes, in good faith, is appropriate or necessary to enforce its Service, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Company�s Application or its servers, and to protect the rights, property, or personal safety of the Company, its users or others. 3.8. User�s Choices: The User may, of course, decline to submit Personally Identifiable Information through the Company�s Application or the Service, in which case the Company may not be able to provide certain services to the User. If the User does not agree with Company�s Privacy Policy or terms of Service, please delete the User�s account, uninstall the Application and discontinue use of the Service; The User�s continued usage of the Service will signify the User�s assent to and acceptance of Privacy Policy of the Company and terms of Service. To protect the User�s privacy and security, the Company takes reasonable steps (such as SMS authentication in certain cases) to verify his/her identity before registering the User�s mobile phone number and granting him/her access to the Service. Third-party Advertisers, Links to Other Sites: The Company is currently ad-free but it may not be kept it that way forever. The Company may have intentions to introduce advertisement into the product and the User agrees for the same. 3.10. Company�s Commitment To Data Security: The Company uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of the User�s personal information. The Company cannot, however, ensure or warrant the security of any information the User transmits to the Company and the User does so at his/her own risk. Using unsecured wifi or other unprotected networks to submit messages through the Service is never recommended. Once the Company receives the User�s transmission of information, the Company makes commercially reasonable efforts to ensure the security of systems of the Company. If the Company learns of a security systems breach, then it may attempt to notify you electronically so that the User can take appropriate protective steps. The Company may post a notice on the Application or through the Service if a security breach occurs. 3.11. In the Event of Merger, Sale, or Bankruptcy: In the event that the Company is acquired by or merged with a third party entity, the Company reserves the right to transfer or assign the information the Company has collected from its Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors; the Company may not be able to control how personal information of the User is treated, transferred, or used. 3.12.
